This paper discusses the vast continuum between the letter of the law (legality) and the spirit of the law (ethics or morality). Further, the authors review the fiduciary duties owed by the firm to its various publics. These aspects must be considered in developing a corporate code of ethics. The underlying qualitative characteristics of a code include clarity, comprehensiveness and enforceability. While ethics is indigenous to a society, every code of ethics will necessarily reflect the corporate culture from which that (...) code stems and be responsive to the innumerable situations for which it was created. We explore the extent to which Anderson's (1987) theory of knowledge compilation can account for the relationship between instructions and practice in learning to use a simple device. Bibby and Payne (1993) reported experimental support for knowledge compilation in this domain. This article replicates the finding of a performance cross‐over between instruction type and task type that disappears with practice on the tasks. The research is extended by using verbal protocols to model the strategies of novice and more experienced (...) individuals. Production system models of these strategies suggest that knowledge compilation only provides an adequate account of practice for one of two Instruction groups. To model the strategy shifts for the second group, we employ a “procedure modification heuristic” (after Neches, 1987), which relies on access to a declarative model of the configuration of the device. This suggests that instructionally derived declarative knowledge may have a subtle ongoing effect on the changes in procedural knowledge with practice. (shrink)

The study sought to determine whether impression management tactics by an employee could effectively lessen the recommended punishment for an ethical rule infraction by this individual. Subjects read a vignette in which an employee violated the confidentiality of personnel records. The employee was presented as either having had a history of previous infractions or no such historical information was provided. Additionally, the employee was described as using either no impression management tactics, an apology, or a justification for his behavior. Result (...) show that in the case of a history of multiple offenses, the employee''s use of justifications effectively mitigated others'' judgments of the wrongfulness of the employee''s action, while apologies did not. Similarly, the justification appeared to lessen respondent recommendations for punishment, prevention of promotion, and demotion/firing, but only when there is a history of multiple offenses. In most cases, apologies tended to exacerbate the problem when previous offenses had been committed. The data are discussed in terms of their implications for the study of employee use of impression management tactics. (shrink)

Emotion regulation (i.e. either up- or down-regulating affective responses to emotional stimuli) has been shown to modulate long-term emotional memory formation. Further, research has demonstrated that the emotional aspects of scenes are preferentially remembered relative to neutral aspects (known as the emotional memory trade-off effect). This trade-off is often enhanced when sleep follows learning, compared to an equivalent period of time spent awake. However, the interactive effects of sleep and emotion regulation on emotional memory are poorly understood. We presented 87 (...) participants with pictures of neutral or negative objects on neutral backgrounds paired with instructions to either increase or decrease their emotional response by altering personal relevance, or to passively view the stimuli. Following a 12 h period of sleep or wakefulness, participants were tested for their memory of objects and backgrounds separately. Although we replicated the emotional memory trade-off effect, no differences in the magnitude of the trade-off effect were observed between regulation conditions. Sleep improved all aspects of memory, but it did not preferentially benefit memory for emotional components of scenes. Irrespective of a period of sleep or wake following encoding, findings suggest emotion regulation during encoding did not influence memory for emotional items at a 12-hour delay. (shrink)

Most people in the United States agree they want some income inequality but debate exactly how much is fair. High‐status people generally prefer more inequality than low‐status individuals. Here we examine how much preferences for inequality are (or are not) driven by self‐interest. Past work has generally investigated this idea in two ways: The first is by stratifying preferences by income, and the second is by randomly assigning financial status within lab‐constructed scenarios. In this paper, we develop a method that (...) combines both experimental control and the social experience of inequality—a simulated society experiment. Across two experiments (N = 138, observations = 690), participants voted on the distribution of rewards—first behind a veil of ignorance, and then when they were randomly assigned a status within a game of chance. Status varied repeatedly across five rounds, allowing us to measure dynamic preferences. Under the veil of ignorance, people preferred inequality favoring the top status. When the veil of ignorance disappeared, self‐interest immediately influenced inequality preferences. Those who randomly landed in top positions were satisfied with the status quo established under the veil of ignorance, whereas those who randomly landed in bottom positions wanted more equality. Yet these preferences were not stable; decisions about the optimal level of inequality changed according to changes in social status. Our results also showed that, when inequality grows in a society, preferences regarding inequality become polarized by social status. Individuals in low‐status positions, particularly, tend to demand more equality. (shrink)

This is the conundrum that gives rise to the issue of tax avoidance: Although governments always seem to lack sufficient funds to support the needs of society, tax codes are often written that offer “a way out” of paying taxes for some but not all constituents. The ways out are referred to as loopholes that allow taxpayers to avoid taxes. This paper first defines the basic terms of tax avoidance and tax evasion and then offers an ethical review of the (...) morality of aggressive tax avoidance. Aggressive tax avoidance is then addressed in relationship a corporate entity’s tone at the top. The conclusion is drawn that use of the letter of the law to avoid payment of taxes sorely needed by governments for the good faith provision of public goods and services is ethically unacceptable. Several suggestions for change are provided, including a new financial statement disclosure and the possibility of a published corporate ethics report. (shrink)

Basic to all motile life is a differential approach/avoid response to perceived features of environment. The stages of response are initial reflexive noticing and orienting to the stimulus, preparation, and execution of response. Preparation involves a coordination of many aspects of the organism: muscle tone, posture, breathing, autonomic functions, motivational/emotional state, attentional orientation and expectations. The organism organizes itself in relation to the challenge. We propose to call this the “preparatory set” (PS). We suggest that the concept of the PS (...) can offer a more nuanced and flexible perspective on the stress response than do current theories. We also hypothesize that the mechanisms of bodymind therapeutic and educational systems (BTES) can be understood through the PS framework. We suggest that the BTES, including meditative movement, meditation, somatic education, and the body-oriented psychotherapies, are approaches that use interventions on the PS to remedy stress and trauma. We discuss how the PS can be adaptive or maladaptive, how BTES interventions may restore adaptive PS, and how these concepts offer a broader and more flexible view of the phenomena of stress and trauma. We offer supportive evidence for our hypotheses, and suggest directions for future research. We believe that the PS framework will point to ways of improving the management of stress and trauma, and that it will suggest directions of research into the mechanisms of action of BTES. (shrink)

The international economy is changing at a rapid rate. The alteration and reduction of both geographical and political borders, coupled with the growing interdependence of socially, politically, economically, and legally diverse countries, have caused multinational corporate entities to revise various policies. These revisions include revisions in marketing strategies, strategic alliances, product and service strategies and, perhaps most importantly as it affects all strategies, a MNC's approach to ethical systems. The truly global company must come to grips with the legal and (...) moral atmosphere in which it operates. The concept of moral rights, those transcending legal or political rights, drives us to review four international codes of conduct and to attempt to develop one international uniform code that might be applicable to any business, in any country or culture. The purpose of this article is to explore the law related to identity theft, to review corresponding rights, and responsibilities of stakeholders involved in identity theft and to formulate a system of best practices businesses could engage in to prevent or reduce identity theft threats. Utilizing two ethical frameworks based on deontological approaches, the authors conclude that there should be a well-defined management scheme to prevent identity theft, which is easy to comprehend and comply with for all stakeholders. Our proposed (...) management scheme incorporates both legal and ethical elements such that identity theft will be more difficult. Further, our proposal would also address business entities’ practices that are so careless that identity theft is made possible at all or made easier: ethical business practice can do much to reduce or eliminate identity theft. In this study, we used a word search puzzle paradigm to investigate age differences in the rate of information gain and the cues used to make patch-departure decisions in information foraging. The likelihood of patch departure increased as the profitability of the patch decreased generally. Both younger and older adults persisted past the point of optimality as defined by the marginal value theorem, which assumes perfect knowledge of the foraging ecology. Nevertheless, there was evidence that adults were rational in terms (...) of being sensitive to the change in RG for making the patch-departure decisions. However, given the limitations in cognitive resources and knowledge about the ecology, the estimation of RG may not be accurate. Younger adults were more likely to leave the puzzle as the long-term RG incrementally decreased, whereas older adults were more likely to leave the puzzle as the local RG decreased. However, older adults with better executive control were more likely to adjust their likelihood of patch-departure decisions to the long-term change in RG. Thus, age-dependent reliance on the long-term or local change in RG to make patch-departure decisions might be due to individual differences in executive control. (shrink)

Markets, corporations, shareholding, management, law, and ethics are all human constructs. A human element seems essential to their existence. Yet, the predominant conception of shareholders as used in academia as well as the business world is thin, generic, and inanimate. This article argues that a thick conception of shareholders as human beings is needed to legitimize and improve managerial decision making under value pluralism, accurately reflect empirical reality of capital markets, and meet moral demands to respect the dignity of the (...) human person. Drawing on the philosophical idea of thick evaluative concepts, the article explores how this idea can be applied to shareholders and begins to examine some of the implications of considering shareholders’ humanity for the responsibilities of and relationships between managers and shareholders. Instructors of business ethics now have a wealth of cases and other pedagogical material to draw on to contribute to achieving ethics learning goals now required at most business schools. However, standard ethics case pedagogy seems to provide more guidance regarding the form and process for getting to a good answer than on the ethical content of the answer itself. Indeed, instructors often withhold their own judgments on what is a good answer so as not to indoctrinate students with the (...) instructor’s views. To answer our question on what is a good answer to an ethical question, we asked three master teachers of business ethics to share their perspectives on a good answer. Their answers revealed stark differences—regarding the starting point of business ethics, the purpose of business, prioritization of analytical disciplines, and research methods—but also a common thread demanding that a good answer articulates a student's own moral voice. Moral voice is a genuine expression of an individual’s considered moral judgment that is reflective of personal values and cognizant of professional expectations. Cultivating the expression of moral voice goes beyond formal and theoretical proficiency to overcome human tendencies toward idealism, insincerity, and rationalization. Moral voice does not by itself fill the gap in business ethics pedagogy on the content of a good answer, but it demands that students support an answer that they can genuinely believe in while encouraging instructors to cultivate in their students sincerity and engagement, conscience, and a sense of self that are indispensable to genuine ethical commitment. A common method for warranting the historical adequacy of philosophical claims is that of relying on historical case studies. This paper addresses the question as to what evidential support historical case studies can provide to philosophical claims and doctrines. It argues that in order to assess the evidential functions of historical case studies, we first need to understand the methodology involved in producing them. To this end, an account of historical reconstruction that emphasizes the narrative character of historical accounts and (...) the theory-laden character of historical facts is introduced. The main conclusion of this paper is that historical case studies are able to provide philosophical claims with some evidential support, but that, due to theory-ladenness, their evidential import is restricted. Integrative social contracts theory is a novel approach to normative questions and has been widely evaluated, discussed, and applied by academics and practitioners alike. While the "I" in ISCT leads the title, it has not received the analytical attention it deserves, especially since the "integrative" component in ISCT is multifaceted and at the conceptual core of the theory. In this paper we therefore take a closer look at two facets of integration. First, we examine the normative integration that takes place (...) in ISCT. For our analysis we draw on theories of legitimacy and obligation. Second, given that empirical inquiry is an important part of the normative integration, we take a closer look at how research that has applied or used ISCT has embraced the empirical components of the theory. Relativism is often motivated in terms of certain types of disagreement. In this paper, we survey the philosophical debates over two such types: faultless disagreement in the case of gustatory conflict, and fundamental disagreement in the case of epistemic conflict. Each of the two discussions makes use of a implicit conception of judgement: brute judgement in the case of faultless disagreement, and rule-governed judgement in the case of fundamental disagreement. We show that the prevalent accounts work with unreasonably high levels (...) of idealization. We defend two claims. First, philosophical discussions of disagreement need to be de-idealized. Second, once a less idealized account of disagreement is available, both our conception of judgement and our understanding of relativism need to be revised. Our example is a case study in the Sociology of Scientific Knowledge: Steven Shapin and Simon Schaffer’s classic Leviathan and the Air-Pump. This case study gives a less idealized account of disagreement that conceptualizes judgements as situated. We argue that this conception can and should be applied to cases of gustatory and epistemic disagreement. The payoff will be a reformulation of relativism in terms of rationally resolvable yet contingent disagreements. (shrink)

This new translation of the first volume of what later became a two-volume work reflects the eloquence and power of Schopenhauer's prose and renders philosophical terms accurately and consistently. This paper presents a survey of the literature on the problem of contingency in science. The survey is structured around three challenges faced by current attempts at understanding the conflict between “contingentist” and “inevitabilist” interpretations of scientific knowledge and practice. First, the challenge of definition: it proves hard to define the positions that are at stake in a way that is both conceptually rigorous and does justice to the plethora of views on the issue. Second, the challenge of distinction: some (...) features of the debate suggest that the contingency issue may not be sufficiently distinct from other philosophical debates to constitute a genuine, independent philosophical problem. And third, the challenge of decidability: it remains unclear whether and how the conflict could be settled on the basis of empirical evidence from the actual history of science. The paper argues that in order to make progress in the present debate, we need to distinguish more systematically between different expressions that claims about contingency and inevitability in science can take. To this end, it introduces a taxonomy of different contingency and inevitability claims. The taxonomy has the structure of an ordered quadruple. Each contingency and each inevitability claim contains an answer to the following four questions: (how) are alternatives to current science possible, what types of alternatives are we talking about, how should the alternatives be assessed, and how different are they from actual science? There is growing recognition that good ethics can have a positive economic impact on the performance of firms. Many statistics support the premise that ethics, values, integrity and responsibility are required in the modern workplace. For consumer groups and society at large, research has shown that good ethics is good business. This study defines and traces the emergence and evolution within the business literature of the concepts of values, business ethics and corporate social responsibility to illustrate the increased emphasis that (...) has been placed on these issues over time. Two organizations that have successfully dealt with these issues were analyzed to identify the links among values, ethics, and corporate social responsibility as they are incorporated into the culture and management of a firm. This study identified the presence and implementation of values, business ethics, and CSR actions within the two organizations studied. (shrink)

This special issue brings to a close a series of three issue of this journal that have sought to expand the philosophical vocabulary of those concerned with business ethics. Previous issues treated the work of Emmanuel Levinas (Business Ethics: A European Review 2007, 16:3) and Jacques Derrida (Business Ethics: A European Review 2010, 19:3), whereas this issue is organised around engagements with the work of Alain Badiou. The three issues together seek to show ways in which the idea of the (...) ethical, in all of its variety, poses grave challenges to the continued practice of capitalist business enterprise. The editorial introduction to this issue introduces the work of Alain Badiou, some of the specific challenges his thought poses for business and business ethics and the papers included in the special issue. Many liberal philosophers view elite education as a virtue of political leaders and, in addition, hold that an important role of a just education system is to create better elites. A compelling and influential articulation of this view has been offered by Elizabeth Anderson. However, this view is in conflict with a commitment to substantive democracy, given the background conditions of the United States today. This article will argue, contra Anderson, that having the highly educated disproportionately represented in political leadership (...) is incompatible with egalitarian principles of democracy. The key reason for this is that it systematically shuts out the working class from full political participation. Therefore, in order to satisfy the constraints of democracy, we must sever the connection between elite education and political office. (shrink)

Within their value chains of suppliers through customers, many businesses are becoming more aware of the environmental aspects and impacts of their organizations. Viewed as a continuum of behavior, business environmentalism can range from simply complying with the law to accepting and pursuing a goal of sustainable development. The point on the continuum at which an organization chooses to operate is reflected in its environmental mission, policies, and actions.
